Terms of Use
These terms govern your use of Rascal, including the Rascal website and the Rascal iPhone app, and the optional Rascal Pro subscription. Rascal is operated by [TODO: legal entity name]. By using Rascal you agree to them. If you do not agree, do not use it. See also our Privacy Policy.
Rider safety
- Never use or touch the app in a way that distracts you while riding or driving. Set up trips and settings while parked.
- Rascal’s routes, directions, place suggestions and AI replies can be wrong, incomplete or out of date. Check them against what you can see, road signs and traffic laws.
- Rascal is not a substitute for your own judgment. You are solely responsible for how you ride or drive, and for obeying the law where you are.
- Calls and messages follow standard iOS interactions. Features are still being developed and tested; do not rely on any feature for safety.
Your account
Some features need an account. Keep your sign-in details secure and give accurate information. You are responsible for activity on your account. Tell us if you think it has been accessed without permission.
Acceptable use
- Do not break the law, harass or threaten other riders, or share another person’s location or details without their consent.
- Do not try to break, probe or overload Rascal, bypass limits or access controls, or use someone else’s account.
- Do not use the AI features to generate content that is unlawful or harmful, or to attempt to extract our system prompts, keys or other users’ data.
- Friends, text, voice notes, location sharing and nearby discovery are opt-in. Only invite and share with people who agree to it.
Rascal Pro subscription
Rascal Pro is an optional auto-renewable subscription for Rascal’s online (server) AI features, including online AI requests and optional server speech. We may make some online features available to signed-in users without a subscription for a time, and may require a subscription for them later.
- Title: Rascal Pro
- Length of subscription: 1 month
- Product identifier: rukky.pro.monthly
- Price: shown in the App Store before you buy, in your local currency. Prices can differ by region and can change; Apple will tell you where required.
- Payment is charged to your Apple ID account at confirmation of purchase.
- The subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period.
- Your account is charged for renewal within 24 hours before the end of the current period, at the then-current price.
- You can manage your subscription and turn off auto-renewal in your Apple ID account settings (Settings > [your name] > Subscriptions) after purchase.
- If a free trial is offered, any unused portion of the trial is forfeited when you purchase a subscription.
- Refunds are handled by Apple. Request them through Apple’s support (reportaproblem.apple.com); we cannot issue App Store refunds ourselves.
When you subscribe, the iPhone app sends Apple’s signed transaction to our server, which verifies it with Apple’s signing certificates and then records your subscription status against your Rascal account. Deleting the app does not cancel a subscription; cancel in your Apple ID settings.
Fair use
Online AI features are subject to short-term rate limits and a monthly fair-use limit on requests per account (assistant, speech-to-text and text-to-speech requests all count). The limit exists to keep the service available and to control costs, and we may change it or the features it covers. If you reach it, online AI features pause until the next monthly period; on-device features on supported iPhones are not metered by it. We may also pause or turn off online AI features, for example for maintenance, provider outages or abuse.
Apple’s terms
The Rascal iPhone app is licensed under Apple’s Standard End User License Agreement (EULA), which applies unless we provide a different license for the app. Apple is not responsible for the app or its support, and Apple and its subsidiaries are third-party beneficiaries of the EULA.
Termination
You can stop using Rascal at any time. We may suspend or end your access if you break these terms, misuse the service, or if we need to for legal or security reasons. Ending your use does not cancel an App Store subscription; manage that with Apple. Provisions that by their nature should survive termination (such as disclaimers and limits of liability) continue.
Disclaimers
Rascal is provided “as is” and “as available”, without warranties of any kind to the extent permitted by law. Rascal is still under development. We do not promise that any feature will be uninterrupted, accurate, error-free or available on your device, headset or in your area, or that AI output is correct.
Limitation of liability
To the extent permitted by law, [TODO: legal entity name] is not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising from your use of Rascal, including any accident, injury, fine or loss that occurs while riding or driving. Nothing in these terms limits liability that cannot be limited by law, including your statutory consumer rights.
Changes
We may update these terms, for example as features change. The effective date above shows the latest version. If you keep using Rascal after an update, you accept the new terms; where the law requires more, we will give you more notice.
Governing law
These terms are governed by the laws of [TODO: governing law and jurisdiction], without regard to conflict-of-law rules, except where your local consumer law says otherwise.
